DEFINITIONS

All persons who complete and sign a Registration Form or Online Booking Form (“the guest”) agree and accept that the below terms and conditions apply to them and any person also occupying or visiting – also referred to as “guest(s)”. Second Flat Retreat 2393 Yaouk Rd, Yaouk, NSW or the common property of 2393 Yaouk Rd Yaouk, NSW.

Terms and Conditions

Second Flat Retreat reserves the right to refuse a booking under any circumstances.

To maintain a good standard for our guests we require certain conditions to be complied with We appreciate most will respect our property but the occasional abuse requires that we state the following conditions.

Parties and Functions are strictly prohibited. The price charged is for domestic us only and not commercial

A Registration Form must be completed by the primary guest and photo ID provided before bookings are officially confirmed. The age of the primary guest making a booking must be at least 21 years.

The house accomodates a maximum of fourteen guests. Bookings are for ten guests. If booking for between ten and fourteen guests, $90 per person, per night charge will apply. Maximum of fourteen guests are permitted to stay at Second Flat Retreat for the duration of the booking. 

Additional guests must obtain the prior approval of Second Flat Retreat management via the following email info@secondflatretreat.com. Failing to comply will mean an immediate termination of the stay with no refund as well as a $1,000.00 breach of agreement will accrue to the primary guest.

**Number of Guests should not exceed the number stated on the Confirmation Notice or subsequently agreed in writing or email. Fees will apply for excess guests not agreed with the owners in advance.**

Occupancy starts and finishes on the dates shown on the receipt. If the occupancy ends or is terminated, the guest must immediately vacate the apartment.

Second Flat Retreat must not be used for any unlawful purpose, professional film or photography shoots must obtain written permission prior to occupancy. There is a strict zero tolerance policy and agreement with the policy of no party, function and no noise after 10pm.

On departure Second Flat Retreat is to be left in a clean and tidy state reflecting as closely as possible the condition in which occupancy began, which includes but not limited to, removing any excess rubbish that does not fit in the bins provided and emptying the refrigerator. Failure to do so will result in a minimum charge of $200.00 and maximum of $500.00 automatically charged to the credit card provided for security.

Please be advised Second Flat Retreat is on a fully functioning Black Angus cattle farm. Our home is located on the same property as Second Flat Retreat, however our interaction with guests is minimal. 

In an event any guest being required to move due to an unavoidable circumstance, the management must be given the first opportunity to find accommodation of a similar standard and in doing so any claims for a refund will not be negotiated or met.

The by-laws, rules and regulations of Second Flat Retreat and any reasonable direction of Second Flat Retreat management must be complied with. The space must be vacated if after receiving a warning, guests fail to comply, are considered to be in breach of the agreement and a minimum $1,000.00 fine will be incurred.

Neither Second Flat Retreat or the caretaker is liable for any damage, theft or loss of property that a guest may sustain while in Second Flat Retreat.

Under no circumstances will owners or managers of Second Flat Retreat be held responsible for adverse conditions of any sort beyond its control. i.e. In the event of, but not limited to; power shortages, sewer blockages, transport or access problems caused by extreme weather events, domestic waste removal, trespassing, noise etc.

All parts of Second Flat Retreat and common property are non-smoking and no pets or animals are allowed.

Second Flat Retreat management may inspect the apartment at any time with reasonable notice and at any time without notice if the manager is of the opinion that there has been a breach of any of the above conditions.

Second Flat Retreat management are not responsible for any aesthetic differences in representations in advertising material generated by Second Flat Retreat and the actual aesthetic presentation of the house during a stay. Items may be swapped out due to damage or other conditions.

The rate does not allow for the extra wear associated with functions in terms of cleaning, garbage removal, wear and tear, repairs etc. Use contrary to this may result in loss of your bond and/or additional payments.

Damage, Breakages, Theft and Loss are the tenants responsibility during their stay. If damage or a breakage occurs on the property, they should be brought to the owners attention as soon as they occur, or additional penalties/payments may apply.

This also includes furniture; furniture should not be moved without the express consent of the owner. Failing to comply may result in additional penalties/payments.

Upon departure, the property should be left in a similar state to its condition on arrival. Check out time is strictly 10.00am to allow time to prepare the property for the next guests.

Disturbance to our neighbours, including excessive noise, is prohibited and may result in termination of rental and loss of bond.

Linen is to be supplied by the property.

Bond is payable at the time of booking. The bond will be refunded within 2 days in full subject to the above conditions being met. It is designed to cover any additional costs incurred including but not limited to, any breakage, damage or excess cleaning requirements, extra guests beyond those declared etc.

PAYMENT

The primary guest will be liable for payment of any charges incurred by any guest, together with all replacements and necessary costs for any damage, loss or theft to the Second Flat Retreat or common property of the house and its contents caused by any guest.

The guest authorises the manager to charge any valid credit card supplied for any loss, damage or monetary contribution for which any guest is liable as part of these terms and conditions or otherwise.

The following payment policies apply and are accepted by guests when booking a stay at Second Flat Retreat. Accordingly we recommend all guests consider purchasing the appropriate level of travel or high risk activity insurance before visiting Second Flat Retreat.


AT THE TIME OF BOOKING

A minimum 50% non-refundable deposit; or for bookings made in full there is no refund option.

Final payment for the booking is to be paid 30 days prior to the start date of the booking. Where the booking is less than 30 days prior to the check in date, the full amount will be paid.

Cancellation if caused by the client, money paid is not refundable unless the house is re-let for the entire period. If a refund is made due to the property being re-let then a $50 cancellation fee will apply.

The owner’s will make every effort to ensure the property is available as booked. However the owners reserve the right to make alterations to bookings due to unforeseen circumstances.

COVID - 19 - For all new bookings made after June 22nd 2020:

Should your stay be affected by government imposed travel restrictions as a result of COVID19, we are offering flexibility in our terms and conditions to allow a credit to postpone your stay. This credit will be valid for use until 1st September 2021.

- For those guests wishing to continue with their travel plans despite travel restrictions imposed by COVID19:
We ask that all guests carefully consider the government advice and legislation current at the time of their stay with regards to travel restrictions and the number of people permitted to gather together both in indoor and outdoor spaces. While our spaces are self-contained, it is the responsibility of the guests to ensure they are adhering to current legislation and maintaining social distancing during their stay. Note failure to comply with government issued advice may be punishable by law resulting in large fines or imprisonment. Second Flat Retreat will not be held liable for any penalties incurred due to guests breach of COVID19 restrictions.

- For those wishing to cancel their travel plans due to travel restrictions imposed by COVID19:
We are offering flexibility in our current cancellation policy to provide a credit for change of date ONLY to postpone any stays that have a check in date occurring before the 30th January 2021. This credit may be used for bookings anytime between now and 1st September 2021.

- For those wishing to cancel their stay entirely:
Guests will be subject to our standard terms and conditions.

- Cancellations or further date changes on COVID19 postponed stays:
Should your postponed dates be affected by COVID19 travel restrictions further rescheduling of COVID19 postponed dates will be allowed on a case by case basis. Future credits are at the full discretion of the owners, under consideration of government advice and travel restrictions in place at the time of future bookings. Any cancellations on the COVID19 postponed stays that are not affected by government restrictions will be subject to the cancellation policy in place at the time of their original booking. ie. if guests were postponing their dates within 30days of their original booking, the new dates cannot be cancelled and will be subject to a 100% cancellation fee of the booking total.

COVID19 CREDIT NOTES:
For all change of date and postponed stays, bookings are subject to the rates at time of new bookings (ie. if guests are moving dates from a low season to a high season, guests will be required to pay the difference at the time of moving their booking to secure new dates. However, if guests are moving their dates from a high season to a low season, any unused credit may be used towards extending the number of nights or adding additional guests. Any small credit under the value of additional nightly stays or additional guests may be used for additional extras such as a welcome platter or bottle of champagne etc. which in turn helps our local suppliers and community to rebuild also.

We are closely monitoring the situation and reviewing this policy as the weeks continue. We will make necessary changes as new government directives arise.

 A Booking may be cancelled due to force majeure, terrorism, natural disasters, political instability or other external events making it unviable for us to uphold the Booking. Where your Booking has been varied or cancelled, we will use our best endeavours to provide an alternative that is substantially the same or as similar as practical to the original Booking, or voluntarily offer you a right to cancel or change a Booking.
